Omaha Escorts: Fired firefighter Bates files appeal
Bates, whose dismissal was upheld by an arbitrator in March, has asked a Douglas County district judge to set aside the arbitrator’s decision.
In a court document filed Wednesday, Bates says arbitrator Bernice L. Fields exceeded her power under federal and state law.
He alleged that Fields refused to consider relevant evidence, conducted the hearing unfairly and was biased against him.
Bates was paid $82,467 as a fire captain.
He was president of the Omaha firefighters union when he was arrested Feb. 3, 2009, in a sex sting at a Council Bluffs hotel. Bates also was a member of the Council Bluffs City Council at the time.
Saying he responded to a racy Craigslist ad seeking only a back massage, Bates was acquitted in May 2009 of a charge of soliciting a prostitute.
